Terms and conditions

CLAN RENT S.L., hereinafter operating under the name "Clanrent.es", is a legal entity established in Spain, CIF B44846681, with registered office at calle Juan Villanueva, num 8, 03203 ELX/ Elche-(Alicante).
Through our Internet resource, we offer you, as a User (you), a virtual platform (Platform) where car rental providers present their services (Rental Services), and you have the opportunity to book a car (Car). All Rental Services will be provided to you directly by the Operator, while we act as an intermediary to assist in the implementation of such services. Our services for you include: - selection of the best operators on the market, based on checking their level of service and efficiency; - the use of an evaluation system to rank operators by quality, in which only the best operators are allowed to participate on the Platform; - quality and performance control of our operators and, if they fail to comply with our quality standards, their participation on the Platform will be terminated; - managing the process of your booking, selecting the Operator and providing communication between you and the Operator for the provision of the Rental Services (collectively referred to as Our Services).
These Terms and Conditions, together with our Privacy Policy (collectively, the "Terms"), define our contract with you to provide our services to you. When booking through Clanrent.es it is assumed that you have read and accepted these Terms and Conditions in full. We reserve the right to change the Terms, so we encourage you to review the Terms from time to time to familiarize yourself with any changes, updates and interpretations. When booking through Clanrent.es you agree to enter into a commercial relationship with the Operator (Agreement). Operators accept our Terms and Conditions and undertake to comply with them when providing you with the Rental Services.
The responsibility for the provision of the Rental Services rests entirely with the Operators. In no event shall we be liable to you, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any lost profits or any indirect or consequential losses arising out of or in connection with the provision of the Rental Services.
The Operators are fully responsible for ensuring that the information about the Rental Services posted on the Platform is accurate and up-to-date, including (but not limited to) rates and availability of cars.

BOOKING PROCESS

  • 1.1 To make a reservation, you need to place an order by filling out the form on our website at the link [ENTER THE APPROPRIATE LINK] (Booking Form) and click the "Book" button. In the process of filling out the Booking Form, you will be required to provide your personal data, including your credit card information (Personal Data), as well as pay the cost of the Rental Services provided (Price).
  • 1.2 Your booking order will be considered confirmed upon receipt of a confirmation email from us (Confirmation) sent to your email address provided on the Booking Form.
  • 1.3 We transmit Personal Data to the Operator, after which the Operator will contact you within a reasonable time and, in any case, before the time and date reserved for the receipt of the service (Pick-up Time), in order to take the necessary steps to provide the Rental Services and request copies of the relevant documents referred to in paragraph 14 below (Documents).

2. WARRANTIES AND OBLIGATIONS

  • 2.1 You represent and warrant that:

    (a) you are at least 18 years of age;

    (b) You have the right to make a reservation and be bound by these Terms;

    (c) If you are making a booking on behalf of a third party, you have the authority to make the booking, you have made the person familiar with these Terms and you have the authority to bind that person to these Terms;

    (d) All personal data provided by you is true, current and accurate.

  • 2.2 You need to:

    (a) Ensure that all information provided on the Booking Form is complete and accurate;

    (b) Indicate on the Booking Form whether the car will be driven by someone other than you, and if so, indicate the name of the main driver (Driver);

    (c) Provide valid master credit card details in the name of the Driver (Driver Credit Card) with sufficient credit limit to cover the amount of the security deposit;

    (d) Cooperate with us in all matters relating to our Services and Rental Services;

    (e) Provide information that we or the Operator may reasonably request in order to provide our Services and Rental Services and ensure that such information is accurate in all material respects;

    (f) When using our website and Platform, avoid any illegal activity, including but not limited to: (i) extracting, copying, reproducing, falsifying and/or otherwise using the information, data and materials available on our website and Platform; (ii) making excessive or repetitive requests, as a result of which the number of requests may (or potentially could) lead to overloading of the system; (iii) uploading, displaying, emailing or otherwise sending any files that contain viruses, codes, text files, software or other elements that may disrupt, interrupt, destroy, damage or limit the functionality of any software, hardware or telecommunications facilities; (iv) disrupt or interrupt our website or Platform in any way; (v) carrying out any illegal activity or activity that may infringe our intellectual property rights; (vi) uploading, displaying, posting, sending by e-mail or in any other way unsolicited or unauthorized commercial or advertising information, spam, chains or any other offers; (vii) uploading, displaying, posting, emailing or otherwise sending unlawful, harmful, defamatory, abusive, racist, vulgar, obscene, threatening, or violent information.

  • 2.3 You grant Clanrent the right to verify the information provided in accordance with clause
  • 2.2 and undertake to cooperate with us in carrying out such verification.
  • We reserve the right, at our discretion, to restrict or terminate your access to our website and Platform without prior notice if you breach your obligations under clause 2.2.

3. PRICE AND PAYMENT

  • 3.1 The price will be determined on the basis of the rates that the Operator applies from time to time in accordance with the terms of your booking.
  • 3.2 Once you have completed the booking form, you will be asked to pay the Price. Upon receipt of your payment, the Operator will issue an invoice using the billing details provided on the Booking Form.
  • 3.3 The price and all other costs associated with the provision of the Rental Services include the amount of value added tax (VAT) payable at the time of the transaction.

4. ESTIMATED LOCAL PICK-UP AND DROP-OFF TIME

  • 4.1 The pick-up and drop-off times and dates specified in the Booking Form shall be deemed to be the local time and date of the location chosen for pick-up and return (local time).

5. INSURANCE

  • 5.1 The price includes insurance premiums for the following policies:
  • 5.2 Third Party Liability Insurance;
  • 5.3 Insurance with a deductible (insurance of a car rental policy, according to which the liability of the policyholder in case of damage to the Car is limited to the amount of the corresponding excess, except in cases where the policyholder intentionally causes damage or is under the influence of alcohol or drugs or improper use of the Car (including, but not limited to, leaving the main roads or allowing a third person to drive the rented car to a person without permission). This "refusal" does not eliminate the franchise completely, but only reduces it. Collision damage insurance covers most of the car, but usually excludes the chassis, roof, tires, windshield, windows, interior, replacement keys, side mirrors, and towing costs);
  • 5.4 Protection against theft (car rental policy insurance, in which the liability of the policyholder in the event of losses resulting from theft or attempted theft is limited to the amount of the corresponding excess, unless the losses were caused by the negligence of the policyholder).
  • 5.5 You should carefully study the terms and conditions provided by the Operator. You should also carefully consider the Operator and, if necessary, ask questions about the exclusions applicable to the above policies, as exclusions may vary from insurer to insurer and from policy to policy. It is not unusual to exclude from third-party liability insurance your family members or people living at your home address, and therefore they are not insured. Additional insurance policies can usually be purchased from car rental service providers; Such policies may already be included in your vacation insurance package, if you have one. Thus, you should familiarize yourself with the full scope of insurance coverage provided by the Operator and, if necessary, take out any additional insurance policy.

6. SECURITY DEPOSIT

  • 6.1 The Operator will require a deposit of an amount equal to the insurance deductible to cover the insurance surplus, any fees arising in connection with the Rental Services and fuel costs, if applicable (Security Deposit).
  • 6.2 The security deposit must be paid with the credit card of the main driver before the pick-up time.
  • 6.3 The Operator will charge the Security Deposit from the Driver's Credit Card upon receipt of the relevant details. In the event that the Operator is unable to withdraw the Security Deposit for any reason, it will not hand over the Vehicle and the Driver will not be entitled to a refund.
  • 6.4 Provided that the Vehicle and any additional items are returned in accordance with the Fuel Policy, in good condition and under the same conditions as they were in upon receipt, the Security Deposit will be immediately returned by the Operator in full upon return of the Vehicle (please note that it may take up to 14 days for the funds to be credited to your credit card).

7. FUEL POLICY

  • 7.1 Each Operator may apply one of the following fuel policies:

    (a) The vehicle must be returned with the same amount of fuel that was in it upon receipt; or

    (b) You must purchase the first tank of fuel and the Vehicle may be returned empty (without refund for unused fuel).

  • 7.2 In cases where the fuel policy is applied in accordance with clause 7.1(b), the price of fuel set by the Operator may be higher than the price of fuel at the nearest petrol station.
  • 7.3 You must check with the Operator the fuel policy applicable to your booking (Fuel Policy) and ensure that the terms of this Fuel Policy are fully complied with.

8. DELIVERY AND RETURN BY THE OPERATOR

  • 8.1 The Operator will deliver and pick up the Vehicle at the address, time and date specified in the Booking Form.
  • 8.2 In the Booking Form, you must select the city or airport where you want the Operator to deliver and pick up the vehicle. Once you make a reservation, you will not be able to change the selected city or airport for delivery and refund.
  • 8.3 Delivery and pickup will be available 24 hours a day.

9. LATENESS, NO-SHOW AND LATE RETURN

  • 9.1 If, for any reason, you are unable to pick up the car at the appointed time, you must contact the Operator as soon as possible and arrange a new delivery time. If it is possible to cancel the delivery, the Operator will not charge you additional fees for this change, but you will be responsible for the full rental price and will not be entitled to a refund. If the delivery cannot be canceled or you do not show up to pick up the car at the scheduled time (no-show), the Operator may charge you additional fees for arranging a new delivery.
  • 9.2 You must return the car on the date and time specified in the Booking Form (Return Date). If, for any reason, you are unable to return the car before the specified Return Date, you must contact the Operator as soon as possible and arrange an alternative time to return the car (Late Return). Late return fees will be charged as follows: Free benefit: 30 minutes; Full day rate: up to 12 hours; Double daily rate: 12 hours or more.
  • 9.3 The operator reserves the right to charge a late return fee at the daily rate, which may be higher than the daily rate applicable at the time of booking.

10. ONLINE CHECK-IN AND CHANGES TO RESERVATIONS

  • 10.1 Once you have made your booking, you will be required to provide the exact address to which you wish the car to be delivered and picked up by the Operator (online check-in). To check in online, you need to log in to the booking system using the access details provided on the voucher.
  • 10.2 You have the right to change the delivery and pick-up address (except for the city and airport selected in the Booking Form) no later than 48 hours before the start of the rental.
  • 10.3 If, for any reason, changes to your booking are required, we will inform you as soon as possible, before the start of the rental. If the proposed changes are unacceptable to you, you will be entitled to a full refund.
  • 10.4 If, for any reason, the vehicle you have chosen becomes unavailable, we will make every effort to offer you an alternative. If we are unable to do so, we will cancel your booking and you will receive a full refund.

11. ADDITIONAL DRIVERS

  • 11.1 During the booking process, you have the option of adding one or more additional drivers.
  • 11.2 The full name and address of each additional driver must be provided during online check-in.
  • 11.3 Additional fees may apply for adding additional drivers.

12. MINIMUM AGE AND ABILITY TO DRIVE A VEHICLE

  • 12.1 The main driver and all additional drivers must be at least 25 years of age.
  • 12.2 If the main driver or any additional driver is at least 65 years old, the rental fee may be increased depending on the country of destination and the operator's policy.
  • 12.3 The operator has the right to refuse to issue a car if the driver's age does not correspond to the minimum age. Any additional driver who has not reached the minimum age will be excluded from the contract.
  • 12.4 The operator also has the right to refuse to issue the car if there are doubts about the driver's ability to drive safely.
  • 12.5 If the operator refuses to issue the car due to the driver's failure to meet the minimum requirements for age or ability to drive the car, you will not be provided with a refund of the rental price.

13. DRIVER'S LICENSE

  • 13.1 The main driver and all additional drivers must have a valid driving licence issued in their country of residence for at least two years. Expired or temporary licenses will not be accepted.
  • 13.2 If the driving licence is written in a language based on an alphabet other than the Latin alphabet or in the ideographic and logographic alphabets (e.g. Greek, Chinese, Japanese, Arabic or Cyrillic), an approved English translation issued by the relevant embassy will be required. 14. DOCUMENTATION

  • 14.1 Upon request, the Driver must provide the Operator with the following documents: (a) the Voucher; (b) the driver's license of the Driver and any additional driver with the relevant additional paper materials; (c) a valid passport or identity card of the driver and any additional driver; (d) The driver's credit card with a sufficient limit to cover the amount of the deposit.
  • 14.2 If the driver fails to present any of these documents, the car will not be handed over by the operator upon receipt and you will not be entitled to a refund of the rental amount.
  • 14.3 The driver must present the originals of all documents to the operator upon receipt of the car and always have them with him until the car is returned to the operator.

15. INTELLECTUAL PROPERTY RIGHTS

  • 15.1 For the purposes of these terms, "intellectual property rights" means copyrights and related rights, patents, rights in inventions, trademarks, names and domain names, rights in design, goodwill and rights to confidential information, as well as all other forms of intellectual property, whether registered or unregistered, including all applications for such rights and forms of protection.
  • 15.2 We own the intellectual property rights to our website and platform. You have the right to print copies from our site and platform and keep such copies on your computer or elsewhere for your personal use only. Any other use is strictly prohibited. Our website and platform may also contain intellectual property rights owned by third parties, including operators. The same limitations that apply to our intellectual property rights also apply to the intellectual property rights of any third party.

16. COMPLAINTS

  • 16.1 If you encounter any problems while using the Platform, making a booking, accessing the booking form or the web registration process, please contact us at [CUSTOMER SERVICE EMAIL ADDRESS] and we will do our best to help you resolve the issue quickly.
  • 16.2 If you are dissatisfied with the rental services, you can file a complaint by contacting the Operator as soon as possible. This can be done orally or in writing, but be sure to keep a detailed record of your complaint.
  • 16.3 The Operator will do its best to investigate your complaint and resolve it in a timely manner.

17. TECHNICAL MALFUNCTIONS AND ACCIDENTS

  • 17.1 All technical problems or accidents related to the vehicle must be reported to the Operator immediately. In case of accidents, it is also imperative to notify the local police and obtain a signed police report. It is necessary to collect all possible data about any third parties involved in the incident. You are not allowed to repair or replace the vehicle without the prior written consent of the Operator. Copies of all documents must be kept throughout the rental period in case of need for the intervention of the insurance company. Please note that compensation may be rejected if this procedure has not been properly followed.

18. CANCELLATION

  • 18.1 You can cancel your booking up to 72 hours (3 days) before the start time of the rental (cancellation period). To cancel your reservation, you need to contact us at [CUSTOMER SERVICE EMAIL ADDRESS].
  • 18.2 If you cancel your booking during the Cancellation Period, you are entitled to a full refund of the cost of the booking. If the cancellation is made after the end of the Cancellation Period, you are not entitled to a full refund of the reservation price.
  • 18.3 The cancellation period does not apply to bookings made less than 72 hours before the start of the rental period (last-minute bookings). In case of last-minute cancellation, you will not be refunded.
  • 18.4 Subject to clause 18.5 below, we reserve the right to cancel your booking immediately with prior written notice if: (a) the Operator suspends or threatens to suspend its payments or is unable to pay its debts as they arise, or admits that it is unable to pay its debts; or (b) the Operator is sued or ordered to appoint an administrator, or notified of the intention to appoint an administrator; or (c) the Operator suspends or terminates, or threatens to suspend or terminate all or a substantial portion of its operations.
  • 18.5 If any of the circumstances described in clause 18.4 occur, we will make every possible effort to offer you an alternative vehicle from another Operator. If we are unable to offer such an alternative, we will cancel your booking and you are entitled to a full refund.

19. FORCE MAJEURE

  • 19.1 For the purposes of these Terms, Force Majeure means an event that is beyond our reasonable control, including, but not limited to, strikes, castles or other labour disputes (whether involving our workforce, the Operator's personnel or another party), disruption of public utilities or the transport system, unforeseen events, war, mutiny, civil unrest, wilful damage, compliance with any law or government decree, rules, ordinances or directives, accidents, breakdowns of equipment or machinery, fire, flood, storm or default by suppliers or subcontractors.
  • 19.2 We will not be liable to you for any delay or failure to perform our obligations under these Terms resulting from a Force Majeure Event.
  • 19.3 If force majeure prevents us or the Operator from providing you with our Services or Rental Services, we, notwithstanding our other rights or remedies, have the right to cancel your booking immediately by giving you written notice and you will be entitled to a full refund of the price of your booking.

20. APPLICABLE LAW AND JURISDICTION

  • 20.1 These Terms and Conditions, as well as any disputes or claims arising out of or in connection with them, their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with Spanish law.
  • 20.2 You irrevocably agree that the courts of Spain shall have exclusive jurisdiction to hear any dispute or claim arising out of or in connection with these Terms, their subject matter or formation (including non-contractual disputes or claims).
